Can my ex-husband ask me to give back his garnished tax return?
My ex-husband had not filed taxes in the last 5yrs, he owes back child support, so when he filed taxes, all five tax returns were garnished. Now he is asking me to give him some of it back to him. Is this legal?

Tell him to drop dead, you owe him nothing (he has no legal ground to get the money returned to him). If he owed back child support, that is why the money was seized. It doesn’t matter that they were for five years as there is no statute of limitations for child support. If you owe it, they will go after it until you die…and then they will take it from your estate.
It is not your problem and if he persists, get your lawyer to write him a letter and explain the word "harassment".
No, his taxes were garnished by a third party to pay back child support to you. You do not have to give him anything at all. It’s is not illegal for him to ask but if he threatens you then it becomes illegal.
He can ask all he wants but it won’t do him any good. If he didn’t owe the back support his taxes would not have been intercepted. He is playing on your sympathies and if you oblige your depriving your child/children of what is rightfully theirs and the states efforts to collect are in vain.

Is it legal for you to laugh hysterically as you hang up on him? Even more so.
If it was leagaly garnished he can’t say shoot. Get a restraining order if he ever says anything about it again. He owes his kids that money spend it on them . If ya breed pay for it!
