How can I get money back that I lent to my ex?
Whilst with my ex, I paid of £3750 of a drug debt for him, as we were a family and it made sense to do so, as I had the money – he has now left, and still owes me the money. I have proof of withdrawing the cash from my savings, and his bank would have proof of me paying it in, but he just refuses to give it back, saying he doesn’t have it. He works full time, earns and OK salary, so don’t see why I should be so out of pocket, as now I am on my own and have children (his also) to look after I really do need the money.
I have thought of small claims court (here in the uk) any advice out there please?

What does the contract say?
OOOPs! Are you saying there was no contract and/or no direct evidence.
Well…. Isn’t that special?
I suppose it’s exactly like all the money I loaned you. Remember that? I bet it slipped your mind.
Let me try to help you remember.
I have proof of withdrawing the cash from my savings, and your bank would have proof of you paying it in.
So. Why don’t you pay me back first?
If the only proof you have is a withdrawal slip from your bank, then you are pretty much out of luck sorry to say.
If you were to take him to a small claims court, he would have to admit that you loaned him the money and that there was a repayment agreement, if he denies it, then you have no proof whatsoever.
Take it as a lesson learned.
Pretty much your only option is going to be small claims court. Be prepared to show any evidence you have. Without a written contract it will be hard to prove but I think you should bring up the withdrawal slips and the courts should be able to order the ex to produce his side of the paperwork (or the court may ask the bank to provide the info).
if u have proof go get it because if somebody had your money then without saying they are suppose to give it you you . but if you lent it to them by work of mouth and no hands were shaked then thats all on you.
Also record him on the phone and if he denies it use it to scam him into court. (YOur not suppose to record anybody with out their permission, so ask him and if he denies then you got that on tape atleast)
either that or just try to BLACKmail him with somethin.
Sorry but like a lot of these cases, in the eyes of the law it was a gift, you have no chance whatsoever of redress legally.
No paperwork, no debt.
I did exactly the same, guess what, all my friends told me not to without a piece of paper, I ignored them and ended up swindled, which I’m afraid has happened to you.
