How can I see if my husbands ex allowed new husband to adopt their son behind husbands back?
my husbands ex is really shady and i was wondering since they live in another state if they could somehow have allowed her new husband to adopt my husbands son without our knowledge? she is 3 kids with 3 different men and she changed the other 2′s last name to his. and now we are worried. yes, we pay child support not thru the state, and yes we see him regularly.

If she somehow managed to get it through the courts, it would not be difficult to show that it is invalid/null and void. As far as names go, if she is not trying to "disappear" the child, and make it so your husband can’t see him, they may be just trying to form a unified family situation, school districts have a most difficult time if the names are not all the same. My husband and daughter have one last name, I kept mine, and you would not *believe* how difficult this is in many situations, amazingly enough.
How old is the child? Is he old enough to understand the issues and give you any information without stirring up the hornet’s nest by asking the adults?
If he has legal custody over him,not likely. But i would get a lawyer and have it part of the payment agreement that that is not an option.
you can’t adopt a child unless the other parent has revoked thier rights. if you can’t find the other parent, then you usually have to post something in the newspaper or whatever. but the fact the your husband is paying child support means he’s obviously in the child’s life. if the other man adopts the child, then your husband would no longer be obligated to pay child support.

Not possible. Since your husband has parental rights, he would have to be contacted and he would have to give up his parental rights in order for his son to be adopted by someone else.
I don’t think she can do it legally without your husband’s (the child’s father) permission, in writing (assuming he is on the birth certificate). Have you done a search for adoptions in that state?
I’m not sure about your state, but here the father would have to give permission also unless he has given up all rights to the child. I’t doesn’t sound like he has in your question.
It would be highly illegal. And what is she doing with your son? If she does not even have your son and is trying to do this without custody then it is a federal offense and a felony. She could end up loosing custody of her children and going to prison.
Adoption cannot be "secretly" done in the US.
If you pay support directly to her, call the child support office in your city/county & have it taken out of his paycheck. The CS office will know if she’s done that, but I really doubt she could’ve pulled it off unless she had a forged document or false death certificate. If she did I’d fight to have her & the new hubby sent to prison
There is no way it can be legally done without his knowledge He has to sign away his rights to the child b4 it can happen! If he never did that then chances are very slim of it happening.There is one thing however than you can do so you can move on with life when a parent is MIA you can run a article in the local newspaper of the last place that he was known to live you must do it for a month stating that your intentions are for this to happen and if they don’t contact back you can proceed with legal proceedings But if this is the case and shes does it in a shady matter the courts can reverse everything.I don’t know if they do that with adoptions I know they can award full custody that way and give divorces that way but never came across an adoption this way but if they can do the other two id say adoption would fall into that category as well Your husband can find things out about his son through the state but only your husband they wont give the step mother any info as fucked up as that is they just wont they say its not your business its between the mom and dad been there done that!!Good luck with your search and I hope everything turns out to be on the up and up just have your husband call the child support division and they can direct him as to where he needs to call good luck to you Hun!
If your husband has JOINT LEGAL, then have him contact the child’s school and get a copy of his emergency card. Then ask the school for a copy of all the records the mom had supplied to them, birth certificates, etc. This will show the kids last name.
I have a feeling, she did not legally change his name, but just changed it. I have been hearing alot of that lately.
Then armed with documentation – contact an attorney and nail her bum to the wall.
The best way to find out is to contact the Vital Statistics agency for the state your husband’s child lives in and obtain a copy of the child’s birth certificate. It is typical for the birth certificate to be changed to reflect the adopting step parent as the father on the new birth certificate.
You should also be able to contact the appropriate county court where adoptions take place and search for any cases containing the name of your husband’s ex and/or her new husband.
