My Ex Husband said he was not getting his refund due to back child support.?
He said it was being withheld for back child support that he owes me. He wouldn’t say when he filed but I’m thinking that he must have filed and he got a letter saying it was being taken for back child support, he even said the amount that i would be getting? How long does it take to get my money?

I would assume the normal processing time it would take for him to get the refund. It should just go strait to you. Though I could see it going through the court that ordered the support first so it may take an extra week or two.

It usually takes a min. mandatory 3 months. It’s the IRS’s rule. Once the 3 month hold time is up on the money, then they send it to the child support office that asked for it, then the child support office sends it to you like any normal payment after they’ve updated their records. Some support offices hold onto tax offsets for 6 months after they get it before they send it to you. There are many reasons for this long wait time, the main one being the possibility of an injured spouse claim, the second big reason is the fact that records take so long to update, and the balance of back support may not be correct. Taking tax refunds are usually large lump sums, and with that large of an amount of money, they want to be extra careful. If an injured spouse claim is filed, the money legally has to be returned to the injured spouse, if any part of it is the injured spouses. And if they already gave it to you, it’s too hard to get back. So expect it to take at least 3 months if not longer.
