How should we file our taxes to get the most back?
My husband works at I don’t. He was less than thrilled last year when they garnished HIS wages from unpaid student loan I had before we got married. He got half of it back it took forever etc. How should we file this year? If we do it seperately we won’t get EIC or Child Tax Credit. Any help? He was real upset with me last year since it was all the money HE earned.Thanks! ![]()

you file jointly, but also file form 8379 as an injured spouse. this will stop him from having to pay his share (1/2) of your the debt. However, this will delay any refund for weeks. It is probably quicker to do it as you did last year.

Student loans are allowed to garnish any of your income in order to get payment. You really need to figure out a way to pay them off because it is really unlikely that you will ever be able to discharge it. Filing separately means that you will lose a lot of credits and will most likely pay a lot more in taxes than jointly.

File a married filing joint return and the injured spouse for him.
And pay off your debt so you don’t have to worry about it anymore.

yes, you are correct that filing separately you lose some benefits
he earned? you are co taxpayers, half of his is yours and vice versa
and if you got EIC that was essentially free money, not money that he paid in
Since the refund was offset last year, you should have made payment arrangements with the student loan and this year they would not offset the refund. But apparently you didn’t do that, so the refund will have to be offset, the sad part is he was not aware of your defaulted student loan, and he should be upset, for you keeping that information from him. File joint return and let the refund go to your student loan to get if paid off.

I have a question. My husband has student loans that were discharged almost 10 years ago, and he lost the paper that discharged them and called to get a copy and then all of a sudden they recinded the loans and asking us for the money plus intrest of 30,000. We need a lawyer but cant afford one right now. They took his tax refund of $800.00. We have one income and I was wondering can I file for injured spose even if I didnt work? This really sucks because we have a family of 6 and dont know what to do, it really feels like an injustice especially since that school he went to long ago was a fraud and the degrees he got are worthless, he has to go back to school to start all over.
