Can I legally take my car back from the repo man without them knowing?
I recently had my car repoed and when going to the yard to pick up my personal belongings out of it and returns the key there was no one around. I could of easily gotten in the car and drove off. would this have been legal? Could the repo man have called the police or since the car is still in my name and was just taken two days earlier could I have just taken it back and been back at square one…late on my payments with a repo order on my car but still in possession of my car?

You would end up in jail for burglary (entering a premises to commit a crime) and auto theft.
No, you cannot. The car is in your name with a leinholder to whom you owe money to. That would be GTA.
Good thing you didn’t you would be in jail right now. That’s stealing, trespassing, and other things I’m sure a lawyer would tell you. Just last night, I was out eating and watching the game. The food was horrible, we didn’t eat half of it, my wife went out to smoke. I wanted to just leave without paying for it, since no one was around. I didn’t I just complained, payed and left.
Illegal and morally wrong. Tip for the future, don’t buy stuff which you blatantly cannot afford, if you choose to do so then expect more of the same.
Reported stolen. Don’t go there
You’d be arrested for car theft. Since you were making payments the car was never technically yours, it belonged to the bank. Once it’s repo’ed you have no claim on it.
It would not have been legal. The reposession papers are similar to a court order. The order of repossession give FULL legal rights back to finance company or thier agents. (in this case, the repo man)
The could have presses charges if you chose to take thier vehicle. It’s not truely yours until it’s paid in full.
Once a car is repossessed, then the vehicle is reported as repossessed with your local police precinct. If the car somehow goes missing after that, then it’s reported stolen and you will be driving around with a vehicle that has a “stolen alarm” on it. So, at anytime your plate is ran by an officer, you can b arrested for GTA.
What a fabulous post made me smile, i wanser if any lawyers know the real answer to this…? great post..
My friend had his car repossessed last month and some of his belongings disappeared when he went back to collect them – namely his mobile phone, laptop and the bluetooth hands-free device. The repossession company said they weren\’t in the car… He reported it to the police and is waiting for them to get back to him. Any advice anyone?
