How do you obtain past and present W-2s for an ex-wife to calculate child support?
A friend of mine has an ex-wife who is lying about her income to obtain more child support from my friend. He needs to obtain her W-2s for this year and the past 5 years, but doesn’t know how to do it. After much web searching and asking, I was hoping someone here would have the answer. Can you petition a court to make her employer hand over these papers? Can you request them from the IRS directly? Any help would be appreciated. Thank you!

PS i have been in court over child support not once did I have to prove my income.
How can she be lying when she would’ve had to provide the courts with proof of her income?

Well, he can get them with a court order. But it also depends on how much income your friend makes.
Alright, for those who do not know how it works, a judge will often let a parent say how much they make without showing proof. Just like one parent can say the other parent is making more then they are if the other parent fails to show to court.
As to your question. He needs to contact his local child support office and ask that his case be reviewed by a judge due to the mother putting false information as far as her income. If one parent feels the other is not being truthful and asks the judge if he/she can request proof of tax return. Sometimes the child support office will even request this if he talks to the right person, which the supervisor is the one to go with. If they do find the information to be different from the amount she claimed in court, they should help him in getting it brought back to court.
In the end, the judge can either credit his account, or reduce the arrears from the date of false information given by the mother, although this is harder to do, but not impossible as my brother found out. Anyway, good luck!
you can only ask the court for a modification in child support which at such time she will have to turn over a financial affidavit and financial disclosure which includes bank statements and the last 3 years of w-2 ‘s but id warn your friend he could be opening a can of worms he doesnt want to open because he could actually end up getting smacked with a higher child support then what he’s paying.. sometimes its better to leave well enough alone, because judges tend not to want to lower a childs child support unless they absolutely have to , so unless he’s taken a huge drop in pay that was none of his own doing, (laid off, pay decrease etc) then the most he can hope for is to keep the child support the same.. and he has to remember also.. Usually if the custodial parent is making more money, more then likely if she has a decent financial life she’s less likely to ask for more child support but if u drag her legally through the mud she’s going to figure if he wants to play it this way, lets play..and counter for more support.. which your entitled to a modification in support every 3 years so if he hasnt had it raised in awhile and he’s making more money then the last time they went to court he could very well end up with an increase if there is a need on the side of the children for an increase and he has the means.. other then that her financial business is none of his business ..
