Can a Wife Be Forced To Pay Husband Back Taxes?
My husband and I have been separated since October 2008 but we are not yet divorced. I filed married but filing separately.
The IRS kept my whole refund because of my husband’s back taxes.
The IRS lady told me (probably after getting upset with me) that they can do anything they want because they are the IRS.
If someone knows if I have recourse, please respond. I need this money to save my house.

That IRS lady’s pretty funny…that reminds me of the old SNL skit about "The Phone Company."
Anyway, it really depends on when the "Back Taxes" were accrued. If they were accrued during the marriage and you had knowledge of them, you are liable. But of course there are always extenuating circumstances. I found the article below to be helpful. Hope you get your refund!!!
I would phone back and talk to a surpervisore and if that does not help talk to some one else and then call your local government offical you should have filed single,also talk to your local legal aid person
Your SSN is tied to the debt. So filing MFS *this* year didn’t do anything because your SSN said you owed. The debt must be on an earlier year when you *did* file MFJ.
