My husbands ex girlfriend wants to move 4 hours away and take the child. Does she need to file anything with the court first? She is saying that she contacted the court and they told her she was free to go ahead and move. He has paid his CS failthfully (I know it’s a seperate issue, just saying) and has never missed a scheduled visitaion. She wants to get married and move. She claimed she lived in one county and really resided in another. Thus my husband got less visitation time that way. What I want to know is in the state of Ohio can she legally move without notifying the court first? On what grounds can my husband take her back to court? Also if he were to file for shared parenting time, what would he have to prove? I need specific examples websites or documents if possible.
Yes she does have full custody. She has no job up there only a man. She has moved up there once before then back down here and now wants to move back up there. It isn’t about the drive. He is concerned about the loss of visitation time due to the drive. More importantly he is concerned with his daughter being moved around everytime her mom finds a new love.
Well quizzard, if you like her so much I’m sure my husband wouldn’t object to you taking her off his hands. What I think your not understanding is that my husband doesn’t care if she moves. His concern is with his daughters well being everytime her mom decides she wants to move. And what I’m asking is can he take her back to court and get things modified. Not whether she is a poor lil victim and can move anywhere she chooses because because my husband is a whiner.

Me and my ex husband have been divorce since june 09. We got joint custody. I was never at the divorce hearing because i was never notify of the court date so what he put down he got. My ex has a new child before we was divorce. Even though we live in different states and he is in the army a phone isn’t that hard to do.He never calls to check up on my son he calls like once a month he gives me child support because he has he said he wouldn’t give it to me but since he has to he does. Now I want to take him back to court because I was sole custody of my 2 year old son. My son has been in my custody since day 1. My ex never sent him a birthday card no christmas gifts his mom gets my son gifts and puts my exs name on it. He makes it seem like he is father of the year. everyone knows he has a daughter but they dont know he has a son. So I want to go back to court to get full custody more child support and to make him pay for daycare since I cant get a job in the daytime since both my parents work and dont get home til like 5 or 6. He refuses to pay for daycare or even help me. I start school next month and have to go at night because I have no one to watch my son in days and that’s why its impossible for me to get a job because no one wants to hire me because of my hours of 6-close most jobs night hours are 5-11.
Im not trying to be some bitter women but you just have to put yourself in my shoes. I just think my son deserves better and I dont want to share my son with someone who doesn’t care about him just because he didn’t want a boy but now has a daughter doesn’t mean anything. Any advice how I can get this court case started??? By the way Im 21 I live in VA and my ex i dont know where he stays he lies about his locations with me

basically the witchy ex wife is not allowing the children to talk to their daddy and not allowing them to come out to see him and scaring them into saying they dont want to. when they arent with her they tell him how much they are excited but when she comes around they get scared and wont. is their anything my friend and her hubby can do? he has seen his kids in over a year and a half since he got back from iraq and he and her were supposed to get them for thanksgiving and next summer but now the witch said no they arent allowed to come. im just wondering if anyone else has dealt with the same thing? is their anything they can do with the law?
the lady is also saying "youll never get the kids, youll never hav full custody ill make sure everyone knows your wife is a bad mother" etc those were the words my friend heard. anything she can do about this witch.

I have been divorced for the past 5 years and have two children with my ex that are now 9 and 6. The girls have a half brother with their father who is almost 2. They like seeing their brother, but hate going to their dad’s house. Their father was sent to prison after our divorce due to drugs. As far as I know, he is clean now, but not sure. He has not paid child support for over 90% of the time that we have been divorced and all the court keeps telling him is to get a job. There is never anything else the court does. I can’t get his taxes because he isn’t working. I have a great boyfriend who loves the girls very much, but we are not married. Therefore he can not adopt the children. We are going to be moving in with my boyfriend within the next 2-3 months in a town about 40-50 minutes from their father. What can I do to make life easier and happier for all of us involved in this situation? My oldest daughter has asked since the divorce (she was 4) to change her last name.
I do have full custody of both of my girls with the right to claim both of them on my tax return.
I was also informed that in order for my daughter to change her last name, he has to consent. I have spoke to many attorney, plus I work for a few. I know it is a very touchy subject – parental rights and name changing
