How do I get my guns back from my ex after a divorce?
Thursday, October 15th, 2009 at
I was awarded several guns from our family colection with my divorce. My ex has not returned them and I am afraid he may have turned them into a gun dealer since he has a restraining order in effect. He also signed at least one or two to my ex-mother-in-law and brother-in-law.How do I find my guns and get them back? What is my recorse if he sold or gave them away?

sadly your best bet is probably to steal them. recourse is to sue and take him back to court for contempt of court for violating a court order.
When you left, you should have taken them with you, if you have a court order, have the police go with you to claim them,,,,
Report them to the police as stolen property. legally they are yours, but your ex is depriving you of possession of your own property which is illegal.
no way same with me but theres no use to use the law here they cant do nothing. just take matters into your own hand you are the new law and do what you think is right. thank the dubya for f’n things up
Very carefully. But seriously, this is about enforcing a court order. See a lawyer about this as it may require legal action to enforce the court order or a lawsuit for civil damages
Just take her to court. Small claims court. Duh that is all you have to do alright. That is if you have the money.
Can you identify the guns? If you report them as stolen you will need Manufacture, model number/name, caliber, and serial number.
I suspect the police, once they know this is a dispute between divorced people, will not accept the report. You best and frankly, most efficient, course of action is a civil suit.
Go back to your divorce lawyer and let him know what is going on. File a whooping big lawsuit for the value of the guns. Your ex will either cough up the guns or have to part with substantial cash.
Speak with your attorney. He should know exactly what to do.
Phone the secretary to the Judge who made the order for him to give you your guns back. They can tell the Judge and he can help if he wants. Probably won’t if you’re female. Otherwise, go to Circuit Clerk in county where divorce was granted with the divorce decree which contains the order (they have the orig) saying (hopefully) exact info re your guns. Do an order of attachment (costs $25 a few years back), and police will go where you say, when (about) you say and get the guns, if they’re there. Last resort besides atty: go to small claims court, take to court, get judgment for huge-overstated dollar value of guns as in perfect pristine condition–get judgment–then do the attachment with that for money, court costs, interest (I usually use 1% simple interest per month)–cannot get family value or your time. If he now lives in a different county, take $ order, enter into court records at his county, and then do the attachment for $. Patience. Any money you spend–include in $amt in the judgment & then attachment.
If he sold them before the order too bad. I don’t think I would like you if we met.
I am sorry this is happening, but all you can do is go back to family court to get them to hold him in contempt for not following the court order to turn it over
